Introduction

Opknap (Pty) Ltd ("Opknap", "we", "us", or "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains what personal information we collect, why we collect it, how we use and protect it, and what rights you have in relation to it, in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA").

This Privacy Policy applies to all Users of the Opknap website, web application, and mobile application (collectively, the "Platform"), whether you are a Homeowner or a Service Provider. It should be read together with our Terms of Service.

By using the Platform, you consent to the collection and processing of your personal information as described in this Privacy Policy. If you do not agree, please do not use the Platform.

Definitions

Personal Information Information relating to an identifiable, living natural person or existing juristic person, as defined by POPIA โ€” including names, contact details, and property information.
Processing Any operation performed on personal information, including collection, storage, use, disclosure, and deletion.
Information Officer The person responsible for ensuring Opknap's compliance with POPIA, contactable at info@opknap.co.za.
Operator A third party that processes personal information on Opknap's behalf under a data processing agreement, such as a hosting or email delivery provider.
Platform The Opknap website (opknap.co.za), web application (app.opknap.co.za), mobile application, and all related services.

Information We Collect

Information You Provide

  • Account details: name, email address, phone number, and password;
  • Property details: address, property type, and features relevant to maintenance (e.g. pool, garden);
  • Task and quote information: descriptions, dates, photos, and documents you upload;
  • Service Provider details: business name, service categories, service radius, qualifications, and pricing;
  • Billing information necessary to process a Subscription, where applicable;
  • Any information you submit through enquiry or interest forms, such as the provider registration form.

Information Collected Automatically

  • Device and usage information, such as browser type, IP address, and pages visited;
  • Log data generated when you interact with the Platform, for security and troubleshooting purposes.

We do not knowingly collect special personal information (such as health or biometric data) unless it is voluntarily provided by you as part of a task or quote description, and only to the extent necessary to deliver the Platform's services.

How We Use Your Information

We use your personal information to:

  • Create and manage your account and provide access to the Platform;
  • Connect Homeowners with Service Providers and facilitate quote requests;
  • Send task reminders, notifications, and service-related communications;
  • Generate SARS-ready tax reports for Landlord Subscribers, based on the information you provide;
  • Process Subscription payments and manage billing;
  • Respond to enquiries and provide customer support;
  • Improve, secure, and maintain the Platform;
  • Comply with our legal obligations under South African law.

We will not use your personal information for purposes materially different from those described above without obtaining your further consent, where required by POPIA.

Legal Basis for Processing

We process your personal information on one or more of the following bases recognised under POPIA:

  • Consent โ€” where you have given clear consent, such as submitting the provider registration form;
  • Contractual necessity โ€” where processing is necessary to provide the Platform's services to you as a registered User;
  • Legitimate interest โ€” where processing is necessary for our legitimate business interests, such as fraud prevention and Platform security, and does not override your rights;
  • Legal obligation โ€” where processing is required to comply with South African law, such as tax or consumer protection legislation.

Sharing & Third Parties

Opknap does not sell your personal information. We share personal information only in the following circumstances:

Between Homeowners and Service Providers

When you request or accept a Quote, the relevant contact and task details are shared between the Homeowner and Service Provider so that they can communicate and complete the Service Agreement.

Operators & Service Partners

We use trusted third-party Operators to help us run the Platform, including cloud hosting providers, email delivery providers, and form-submission services used on our enquiry pages. These Operators only process personal information on our instruction and are contractually required to keep it secure and confidential.

Legal Requirements

We may disclose personal information where required by law, court order, or to protect the rights, property, or safety of Opknap, our Users, or the public.

Business Transfers

If Opknap is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy continuing to apply.

Section 07

Cookies & Tracking

The Platform uses essential cookies and similar technologies necessary for login sessions and core functionality. We may also use analytics tools to understand how the Platform is used, in order to improve it.

You can control cookies through your browser settings. Disabling essential cookies may affect your ability to use certain features of the Platform, such as staying logged in.

Section 08

Data Security

We implement reasonable technical and organisational measures to protect your personal information against loss, unauthorised access, alteration, or disclosure, including encrypted connections (HTTPS), access controls, and secure cloud infrastructure.

No method of transmission or storage is completely secure. While we work to protect your personal information, we cannot guarantee absolute security. If we become aware of a security breach that affects your personal information, we will notify you and the Information Regulator as required by POPIA.

Section 09

Data Retention

We retain personal information for as long as your account is active, or as needed to provide the Platform's services to you. Where you close your account, we will delete or anonymise your personal information within a reasonable period, except where we are required to retain it for longer to comply with legal, tax, or accounting obligations, or to resolve disputes.

Section 10

Your Rights

Subject to POPIA, you have the right to:

  • Request confirmation of whether we hold personal information about you;
  • Request access to the personal information we hold about you;
  • Request correction or updating of inaccurate, outdated, or incomplete personal information;
  • Request deletion or destruction of personal information we no longer have a lawful basis to retain;
  • Object to the processing of your personal information on reasonable grounds;
  • Withdraw consent, where processing is based on consent, without affecting processing that occurred before withdrawal;
  • Lodge a complaint with the Information Regulator of South Africa if you believe your rights under POPIA have been infringed.

Section 11

Cross-Border Transfers

Some of our Operators, such as cloud hosting and email delivery providers, may process personal information on servers located outside South Africa. Where this occurs, we take reasonable steps to ensure that the recipient is subject to a law, binding corporate rules, or an agreement that provides an adequate level of protection substantially similar to POPIA.

Section 12

Children's Privacy

The Platform is intended for use by individuals who are at least 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have inadvertently collected personal information from a child without appropriate consent, we will take reasonable steps to delete it.

Section 13

Changes to this Policy

Opknap may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. Where changes are material, we will provide notice via email or a prominent notice on the Platform before the updated policy takes effect.

The current version of this Privacy Policy is always available at opknap.co.za/privacy. We recommend that you review it periodically.
